PUBLIC OFFER AGREEMENT FOR THE PROVISION OF PSYCHOLOGICAL SERVICES
This document is an official and public offer of the psychologist Olena Tagachenkova to enter into an Agreement for the provision of psychological services with any person, hereinafter referred to as the “Client”, who accepts the terms of this offer.
1. General Provisions
1.1. This Offer is an official proposal by the Psychologist to enter into an agreement for the provision of psychological services.
1.2. The Agreement is considered concluded from the moment the Client accepts this Offer. Acceptance is confirmed by booking a consultation, making a payment for the services, or actually receiving a consultation.
2. Subject of the Agreement
2.1. The Psychologist provides the Client with psychological services in the form of consultations, therapy sessions, coaching sessions, trainings, and other related formats. The Client agrees to pay for these services in accordance with the terms of this Agreement.
3. Terms of Service Provision
3.1. Services may be provided either in person or remotely, online via video call.
3.2. The duration of one consultation is agreed upon by the parties and usually lasts 80–90 minutes.
3.3. The Client agrees to attend the consultation on time. If the Client is late, the consultation time is not extended. If the Psychologist is late, the duration of the service is extended by the corresponding amount of time.
3.4. Cancellation or rescheduling of a session is possible no later than 24 hours before the scheduled time. Otherwise, the reserved time must be paid for. If the Psychologist fails to give notice, the next consultation will be provided free of charge.
3.5. Force majeure situations are discussed separately.
3.6. Psychological services are not a 24/7 crisis support service. In case of an emergency or acute crisis, the Client should contact emergency services or specialized support services.
4. Payment for Services
4.1. The cost of the Services under this Agreement is specified in the invoice issued by the Psychologist or based on the agreement between the parties.
4.2. The cost of the Services may be reviewed once a year.
4.3. The Client must make the payment no later than 48 hours before the scheduled start of the Service. The time slot is reserved for the Client only after full payment has been made.
4.4. Payment for the Psychologist’s Services is made on a 100% prepayment basis, unless otherwise agreed by the parties.
4.5. In case of early termination of the work, payments for consultations already provided are non-refundable.
4.6. Payment system fees and bank fees are paid additionally by the Client.
5. Rights and Obligations of the Parties 5.1. Rights and Obligations of the Psychologist
The Psychologist is obliged to:
- provide the Services conscientiously, using scientifically grounded methods and within the limits of professional competence;
- respect the dignity and autonomy of the Client and create a safe space for open discussion of problems;
- ensure the confidentiality of all information received during consultations and not disclose it to third parties without the Client’s consent;
- be responsible for the storage and processing of the Client’s personal data, ensure its confidentiality, and use it solely for the purpose of providing high-quality services.
The Psychologist has the right to:
- personal privacy and respect;
- disclose confidential information to third parties, including relevant services, in cases required by law or when necessary to prevent serious harm, protect vulnerable persons, or report serious crimes;
- where possible, discuss the situation with the Client before disclosing information, and in urgent cases or when contact is impossible, notify the relevant authorities without prior notice to the Client;
- record and document the process of providing Services without indicating the Client’s personal data, as well as conduct photo or video recording for the purpose of improving the quality of work, including within supervision practice, only with the Client’s prior consent;
- terminate the provision of Services without refund in case of immoral or antisocial behavior by the Client, if the Client is found to be legally incapable, or if the Client violates any provision of this Offer.
5.2. Rights and Obligations of the Client
The Client is obliged to:
- not attend a consultation under the influence of alcohol or drugs;
- in case of an online consultation, ensure proper conditions for participation in the session: absence of third parties, silence, and a stable technical connection;
- refrain from eating and drinking during the session, except in cases of objective necessity, in order to ensure full involvement in the therapeutic process;
- in order to maintain confidentiality and professional ethical standards, not make audio or video recordings, screenshots, or any other recording of the session content without the prior written consent of the Psychologist;
- provide complete and truthful information about themselves, including information about their health condition, medication use, and consultations with other mental health professionals, where relevant for proper psychological support;
- understand responsibility for their own decisions and actions and recognize that psychological support is a collaborative process;
- voluntarily consent to the processing of personal data obtained as a result of the legal relationship under this Offer.
The Client has the right to:
- receive the Services on time, with proper quality, and in full accordance with the terms of this Agreement;
- stop receiving the Services at any time at their own discretion. In the case of individual or couple consultations, the Client agrees to notify the Psychologist in advance and attend one final consultation after informing the Psychologist about the decision to end the work;
- understand that responsibility for further decisions and their psycho-emotional state after termination of the Services rests with the Client.
6. Dispute Resolution and Applicable Law
6.1. The parties agree to resolve all disputes through negotiation.
6.2. If no agreement is reached, the dispute shall be resolved in accordance with the current legislation of Italy, at the place where the Psychologist carries out her professional activity.
6.3. If any provision of this Agreement is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions of the Agreement, which shall remain valid and binding on the parties.
7. Validity of the Offer and Other Terms
7.1. This Offer is valid from the moment it is published on the Psychologist’s website.
7.2. The Psychologist has the right to amend the terms of this Offer. The updated version becomes effective from the moment it is published on the website.
7.3. The Client is responsible for independently monitoring any changes to this Offer.
